How Judges of the Supreme Court and Bombay High Court, connived and passed perverse orders, to help corrupt Judge Shri V L Achilya become a High Court Judge on 18.10.2013 and immediately next day on 19.10.2013, supporting MPID Court Judge passed orders for eviction of undersigned aged 66 from flat, which for he has paid Rs 51 lakhs to Banks in 2005. Presently homeless in Mumbai.

Respected Sir,

I the Petitioner not being an Advocate, am disclosing below to the best of my ability, what each of these Judges have done wrong and deliberately passed orders, which defy human intelligence.




Shri V L Achilya as MPID Judge in 2005    
As MPID Court Judge in March 2005, Judge Shri V L Achilya had ordered an FIR against me for breaking seal of court put on property, when there was no order ever passed to seal the flat and the flat was never sealed. Property was sold to me by Joint Asset Sale Committee of 2 Banks and no action was taken against officers of the 2 Banks for selling property which was subject matter of attachment by the court. Bank Applications filed on 25.2.2005 for lifting attachment, as the property does not come under the MPID Act are not heard till today. Amount paid Rs 51 lakhs in 2005 remain with the Banks even today.

This FIR was filed 24.3.2005 for trespass at Khar Police Station and CR 103/2005 registered, I was arrested and remained in Police custody for 5 days, thereafter till today (after over 9 years) there is no progress of trial by Magistrate’s court at Bandra, Mumbai.

On 4.5.2005 I had filed a Complaint with DGP Maharashtra about an Agent Manish Agrawal - mobile 09826022552 of the MPID Sessions Judge Shri V L Achilya, - negotiating on mobile Phone from the Court corridor - for bail of an accused Director Of Soundcraft Industries Ltd., (Rs 1000 Crore fraud case) with MD of the company who had fled from India to New York.

The DGP forwarded this complaint to the Commissioner of Police - Inquiry was conducted in 2005, however I have been unable to get a copy of the Inquiry report till today, inspite of 2nd Appeal to Information Commissioner under the RTI Act and then Me and my wife filed Criminal Writ Petitions 3 times, in 2008 (WRIT PETITION NO.  1246   OF 2008), 2012 (APPWST/230/2012 in Cr WP 717 0f 2012 ) and in 2013 (CrWP/2937/2013) at Bombay High Court to get this report - But did not succeed.

The next Judge of the MPID court heard my case and discharged me of the Act of breaking seal of Court on 30.1.2006. The MPID Court Judge however had no power to withdraw the FIR.

Judge Shri A M Khanwilkar and Judge Shri A R Joshi of the Bombay High Court passed perverse order on 27.9.2012.

In October 2005, I had filed Criminal Writ Petition 2414/2005 for cancellation of FIR filed against me on 24.3.2005 and Punjab National Bank had filed Criminal Appeal 688/2006, challenging the MPID court order of 30.1.2006, discharging me of the act of breaking court seal. Both these were heard by the 2 Judges together and they passed order on 27.9.2012 dismising CrWP 2414/2005 and allowing Appeal of PNB. These ‘Hon’ble’ Judges shockingly concluded in para 12-13, that “Chhugani had filed Writ Petition in 2005, whose prayers were solely based on the order of the MPID court passed in his favour on 30.1.2006”.

Further every para was wrong on facts. Significantly while it was Punjab National Bank which filed 4 Criminal Writ Petitions at Bombay High Court, to evict me from flat but did not succeed, these ‘Hon’ble’ Judges concluded exactly the opposite and state in para 10 “In fact, various steps were taken by Indur Chhugani to continue with his occupation over flat Nos.501 & 502 and he preferred various Misc. Applications / Writ Petitions before this Court, but, without any success”.
The order was totally silent on payment made to the Banks or facts brought out in MPID court order from Para 18-22 dated 30.1.2006 and Judges have misused para 23 which states  as below:
“23. In the light of the above discussion, there is no
convincing material available on record against the noticee Chhugani regarding the alleged removing of seal of property attached by the order of the Court and making illegal entry into the property attached by the Court and especially in the light of registration of F.I.R. into the matter which is pending investigation. The said show-cause dated 22.3.2005 is hereby discharged.”

After this order was passed, I approached The Supreme Court through Criminal Special Leave Petitions no 2308/2013 and 2309/2013. These were heard by the 2 Judges, who refused to consider any correct facts, refused to even pass an order that Applications pending at the MPID Court since 2005 be heard prior to Applicant who is a senior ctizen being evicted from flat for which he has paid Rs 51 Lakhs in 2005. The Judges taunted, there can be no flat in just Rs 51 lakhs at Mumbai, refusing to consider that this property was sold in 2005, 8 years earlier. Both SLPs were dismissed on 1.3.2013 in less than 3 minutes.

At the MPID court, the Judge refused to order my eviction from property though the Supreme Court had dismissed my SLPs and stated that only after hearing under Section 8 of the MPID court, can anyone be evicted. This was in keeping with order passed in my favour earlier by the Bombay High Court in Criminal Appeal 1409/2011 passed on 12.12.2011 (order copy attached ).

However, it was the elevation of Shri V L Achilya as a Judge of the Bombay High Court on 18.10.2013, which changed everything at the MPID court, and an order was passed on 19.10.2013 for my immediate eviction from flat in 2 weeks.  Was informed later, that the Investigating Officer had conveyed a message from Shri V L Achilya to the Judge at the MPID Court on 19.10.2013.

Rekha Chhugani moved Bombay High Court.
My wife Rekha Chhugani moved High Court through Criminal Appeal 1276/2013, as she was the owner of Flat 501, and there was no order against her and no notice to her. But this Appeal was dismissed on 5.12.2013.

Next morning, on 6.12.2013 we were forcibly evicted from Flat 501, 502, Pinky Panorama Co-operative Housing Society Ltd., by the Police, though the Bombay High Court had not appointed them as executing authority of the High Court order dated 27.9.2012, which had stated “We also direct the respondent no.1 to forthwith vacate the said Flat Nos. 501 and 502 and surrender possession thereof to the Authority of M.P.I.D. Court and the said M.P.I.D. Court shall deal with the pending proceedings in accordance with law”.

The Police simply, removed the nameplate ‘Rekha Chhugani Flat 501’ and took it away and pasted Notice against ‘Indur Chhugani’.

Thereafter Mrs Rekha Chhugani approached the Supreme Court. Though the Supreme Court passed order in SLP (Crl) No 210/2014, on 24.1.2014 for speedy disposal of matter pending at MPID Court since 2005, no say has been filed by the State of Maharashtra till today and the MPID court pays no heed to the Supreme Court directive received through me first (order dated 24.1.2014) or later from the Supreme Court directly.

MPID Court seems to care not for this Supreme Court directive, the case was adjourned on 5.4.2014 to 4.6.2014 then to 8.8.2014 next date now given is 1.10.2014.

We are presently homeless on account of order passed most unjustly and illegally by the Bombay High Court, then the Supreme Court which supported this illegal order. All these orders were passed to facilitate the induction of Shri V L Achilya as a Bombay High Court Judge ( he was earlier Principal Secretary, Ministry of Law and Justice of the State of Maharashtra ).

Can we as Senior Citizens hope to get Justice and get our home back for which we have paid Rs 51 lakhs in 2005.

Mumbai: Police posts in Mumbai are breaking the law. More than 300 police posts (beat chowkies) in the city have no sanction either from the home department or the municipal corporation.

Around 21 police posts have been built from funds provided by builders and private companies. That’s the startling fact Mumbai resident Indur Kartar Chhugani got from the state Home Ministry after filing a Right to Information (RTI) application.

"These chowkies have been constructed without BMC permissions and they do not pay municipal tax. They steal power from nearby shops, buildings or lamp-posts and many of them have been funded by some builder or with someone with a vested interest," says Chhugani.

The Home ministry has neither funded nor given approval to any beat chowkie in Mumbai. No information on approval received for these chowkies from the municipal ward office.

Chhugani has filed a public interest litigation before the Bombay high court that these beat chowkies be demolished. "How will any complaint ever get registered against these builders or goons who sponsor these chowkies?" he says.

Rogues want money ...to hell with the law

Impossible for poor to fight the Rogues in Uniform

It is impossible, for them to get justice...I am an educated person from Mumbai and
I have a first hand experience.

Police can fabricate cases against anyone..I was arrested, by the corrupt police in Mumbai,
and put in jail for 5 days, on orders of a man who has absconded from India, after commiting
a fraud of Rs 1000 crores.

Police can create evidence and destroy evidence...tomorrow they can even kill me and claim
"Chhugani was a criminal". ..They will not inform that "We filed a bogus case against him
because he refused to pay us initially"..

It requires massive efforts to fight back, they all
gangup to suppport their Rogue colleagues..When you reach the highest police authorities..
all they do is conduct a bogus enquiry to clear the Rogue in uniform....

Background details of Case pertaining to myself ( I K Chhugani )

Am a Mechanical Engineer, 58 yrs of age, considered as the pioneer of the Yellow Pages Industry in India. Pioneered the concept in 1984 by publishing Selpages.

At the peak my Company Sellaids Publications I Ltd., of which I continue to be the Managing Director, employed over 300 people (mostly graduates) in Mumbai, Pune, Calcutta, Guwahati and Bangalore.

My business is respectable , high profile, which brought me also in touch with leading Police officials like, PCs Soman, R D Tyagi and Dr P S Pasricha, who incidently is in the news.

Competition from the Tata Group , in the form of Tata Yellow Pages, was our undoing, I fought the competition fiercely and lost.

My financial Problems began in 2001/2002. Finally I was compelled to sell off my office, and even my home at 201/202, Pinky Panorama. In the 1st week of June 2004, I contracted to sell my flat on the 2nd floor, with condition that the possession will be given by 30th September 2004, as we had fixed my Daughters wedding on 21st August 04.

On 23rd June 04 The PNB officers came to attach the flat 502 in our Building, they met me & could not locate 502, I helped them out & explained that 501/502 was a composite flat with one door. Also I was told by them that they would sell the flat within months.

At that time, I was a MC member and my wife was the treasurer of the Society, Mr. Rohira was the Chairman, Mr. Raj Basantani was the secretary. He was absconding.

I was eager to locate Bharat Overseas Bank Ltd, who I was told, had the mortgage for 501, since in the garage of flat 501 was staying a Gunman, kept specifically for intimidating the Society Management commitee, into transfering the Flat no 701, which was sold by Power Of Attorney holder of Raj Basantani, after he absconded.

The Khar Police had expressed their inability to do anything, as the man had a license for the gun, and we were told that to evict him from the building. the society will have to approch a court as it would be a civil matter. (This same Khar Police later arrested me, though the dispute was clearly civil and the persons if any were to be arrested, were the Bank Officers.)

With PNB help. I located Bharat Overseas Bank Ltd., Chief Manager, Mr Mihir Datta, who was delighted to meet me & said I was a God send person for him. I requested Mr. Datta, to take possesion of 501 along with Garage, so the Gunman gets evicted. But he was a very scared person, who needed immense persuasion, from me to take possession.

Finally, he came to take possession on 28/7/04, he only pasted the notice on the flat 501 door and was interested in doing the same for the garage, but I and other Society members insisted on the Gunman to take his bag & move out, we gave a lock to Mr Datta, to put on the garage.

That night the Gunman and Basantanis driver, came around 11 pm, to break open the Garage lock, which I stopped along with Mr. Rohira, the Chairman. After about 30 minutes, I started getting threatening calls from Dubai, saying I will not be allowed to live more than a week. On the morning of 29th July 04, I registered a NC at Khar Police Station at 9:45 am (NC 1533/04), against Suresh Basantani and Raj Basantani.

The Banks needed a lot of help and understanding, both did not know how much area was 501 & 502. They squabled, PNB insisting on 50% share, whereas BOBL insisted rightly, with help from me, 501 is 641 sq ft and 502 is 398 sq.ft. I was literally an arbitrator between 2 Banks.

Punjab National Bank Ltd., had advanced over Rs 8 Crores against the 398 sq.ft flat and Bharat Overseas Bank Ltd., had advanced Rs 4 Crores against the 641 sq.ft flat. Normal people like me and you, would not get more than Rs 10 lakhs, against such properties.

Both banks requested me to allow their valuers to look thru my flat 201/202 as 501/502 was identical. I allowed them to do that. I already had expressed my interest in buying 501/502 from them, I felt I will get these at a reasonable price, considering the complications.

I t was September now and still I did not know, when the Banks will be able to sell, even if my bid is the highest. I pursued both the Banks.

Finally Mr Datta expressed, that if I could help them at the Presidency Magistrates Court to get physical possession, they will sell the flat within 15 days to the highest bidder. Thereafter it is your luck, they said.

So I followed up with the Registrar at Presidency Magistrates Court and explained again the problem of 2 flats having a single door. Finally on 12th October 04, Both banks got physical possession, I am recorded as a witness.
I had already given possession of my Flat on 30th September 04, but the buyer allowed us to continue to live in the flat, while part of the flat was occupied by them. I was desperate now, and promised the buyer, I will move my furniture out on Dassera day 22nd October 04.

I followed both Banks on a daily basis, on 21st October 05, both Banks formed a Jt committee and considered 4 offers, of which mine was the highest, I understand now from Court records.

However a decision was taken by the Committee to meet again on 28th October 04, as per the rules, the Valuation had to be done again after getting physical possession. Valuation was again done on 23rd October 2004.

The Committee met again on 28th October, but again no decision was taken. The next date was 25th November, I was told.

On 30th October 04, I got my furniture packed and sent for storage to Bulwark Warehousing and me and my family moved in to ABs Service Apartments, at Bandra. For 12 days we stayed there. Afterwards we got a small apartment, which had actually been converted into an office, to stay. In this Flat we stayed till 26th Feb 05. All this time we ate out in restaurants, as the flat did not have a kitchen.

All along, the Banks, kept saying it will take only 1 week more. Finally on 15th January 05 they said we will call for tenders, which they did. I bid with a Earnest Money deposit of Rs 5 lakha on 15th February 05, and was the only bidder.

Their tender terms were, "Full Payment within 1 week". Tenders were opened on 18th February 05 and full payment was made by us on 25th February. (

What suddenly caused all the upheaval was, initially the Rs 5 lakhs bribe demand from Mr.Mihir Datta of Bharat Overseas Bank Ltd., (which I refused to pay) and later the supposedly attachment of the flat by the MPID court, which was to be implemented by the EOW of Mumbai Police on 8th february 2005.

Setting the Rogue Police Officers in Mumbai or any other large city in the country, to change their ways, is not difficult. Needed is will power, devotion of time (4-8 hrs a week) and the confidence that it can be done.

There is a massive force in Mumbai and in many other cities, which needs to be tapped. The force I am referring to, is young elderly people who have either taken VRS, or have just retired age 58. All those who are healthy up to 65-70 yrs could join in a crusade to make the corrupt rogues shiver.

Mind you, I am referring to highly experienced, highly qualified Retiree Engineers, Doctors, Lawyers, Police Officers, Judges, Army men, Teachers and Businessmen, people who are financially self sufficient. Who do not know what to do, with time on their hands.

This segment of people are at a point in life, where they see no goals to achieve, see no purpose in going on living. If a noble goal of reforming the Police in India is shown to them, they will feel rejuvenated, they will find a purpose in life, and believe me all it will take is 80-100 elderly people to keep tabs on each Police station in their own area only.

A committee of 5 or 7 or 9 could be formed in each police station area, to look into serious lapses on the part of the local police station. A force like this will sent the corrupt running for cover.
Yes, it will take a bit of organising. Which experienced people will not find difficult.
If I alone, at age 58 can take on the rogues at Khar police station, and send them scurrying, think what 80-100 can do together.
